Can a surrogate interrupt a pregnancy?
In Colombia, every woman, including surrogates, has the right to terminate within the first 24 weeks of pregnancy, as affirmed by the Constitutional Court. This right cannot be waived by contract. However, prospective surrogates undergo rigorous psychological evaluations as part of the selection process to ensure they are fully prepared for the emotional, mental and physical demands of surrogacy, which helps reduce the likelihood of such occurrences.
Can a surrogate work throughout the pregnancy?
Yes, surrogates are permitted to work throughout the entire pregnancy unless advised otherwise by a healthcare provider. The right to work is upheld by Colombian law and cannot be denied to any Colombian citizen.
What citizenship does the baby get?
The baby initially obtains Colombian citizenship upon birth. Subsequently, the citizenship of the biological parent[s] may also be conferred on the baby either at birth or upon demonstrating a biological connection. However, the Colombian citizenship is relinquished following the completion of the maternity impugnation process, solidifying the legal and familial ties between the baby and the biological parents.
How long does it take from start to end?
The surrogacy journey, including the preliminary steps leading up to embryo implantation and the subsequent 9-month gestation period, typically takes 14 to 18 months. However, it’s important to recognize that biological processes can vary due to several factors, such as the need for multiple transfer attempts and the health and readiness of egg donors and gestational carriers. Our partnerships with leading clinics, which maintain an average success rate of 80%, significantly improve the chances of a successful pregnancy in a timely manner.
Can I see the egg donor?
In accordance with Colombian law, egg donation in Colombia is strictly anonymous, and sharing photographs of egg donors is prohibited. Instead, clinics offer a detailed donor phenotype, carefully matching the donor based on your genetic markers and preferred characteristics. This ensures the protection of both the donor's identity and the privacy of the intended parents, preventing any unintended future connections. Alternatively, if access to photos of your egg donor is a requirement for your family planning needs, you may secure egg donor rights in a country where photos are permissible and have the eggs or embryos shipped to one of our partnered clinics in Colombia.
